INTERNAL REGULATION AND OPERATING PROCEDURE FOR THE STUDENT RESIDENCE LEEVIN ACCOMMODATION SPAIN LOCATED IN BARCELONA, VÍA AUGUSTA 289

FIRST.- GENERAL PROVISIONS.

The LEEVIN ACCOMMODATION SPAIN student residence (the “Residence”) will exclusively provide accommodation to members of the educational and academic community or those directly related to it for teaching or research purposes.

This Regulation aims to establish the basic rules of conduct to ensure good coexistence among residents, the proper functioning of common services, and to provide the building and its residents with tranquility and security, both in private use areas and common areas.

Residents will have the right to use the private areas of their room for their own interests, provided they do not harm or interfere with the stay and rights of other residents and commit to doing nothing that may compromise the integrity of the building, disrespect its purpose, or disrupt an environment conducive to education and learning.

Acceptance of the conditions will be an essential requirement for staying at the Residence, and residents are obliged to respect its content as well as that of this Internal Regulation and operation.

This Regulation legally binds all residents, who will be responsible for acts and deeds constituting a breach of the provisions of this regulation.

SECOND- ACCOMMODATION REGIME.

The minimum stay at the Residence is 4 days/nights.

Residents wishing to stay at the Residence during other periods must communicate this to the Residence within the established period. Stays at the Residence before or after this period must be specifically reserved and will be subject to the general price rate in force at each time.

Partial use of the room by the Resident will imply the payment of the full rate.

THIRD.- CHECK-IN AND CHECK-OUT.

Check-in time is from 15:00 on the day of arrival, and check-out time is until 11:00 on the day of departure, from Monday to Sunday.

If check-out is done later than designated time (11.00 am) the following fines apply:
From 11.00 to 15.00 – 50% of the daily price of the room.
From 15.00 and later – 100% of the daily price of the room.

FOURTH.- CHANGES AND CANCELLATIONS.

  1. Modifications and cancellations must be made in writing via email to the following address: info@leevinspain.com.

In the event that the resident wishes to cancel or modify their reservation, the amount previously paid will be refunded to the resident if the cancellation or modification is communicated to LEEVIN ACCOMMODATION SPAIN 14 days in advance of the start of the accommodation period. If the resident does not comply with this notice, in the case of cancellation up to 13 days before the arrival date to the accommodation, 50% of the total amount of the reservation will be charged to the resident.

The management costs of the reservation will never be refundable.

Cancellations due to weather conditions and/or delays and cancellations of flights or other means of transport are not accepted.

No refund will be made in case of expulsion.

Early departures, for any reason, do not entitle to any refund.

FIFTH.- DESCRIPTION OF ACCOMMODATIONS, COMMON AREAS, AND SERVICES.

  1. A) All rooms that make up the Residence consist of a bedroom with a full bathroom.
  2. B) The Residence offers the following services, activities, and spaces reserved as common areas for residents:
  • Dining room/kitchen.
  • Living rooms
  • Study rooms. Access to this room is permanent and at any schedule, maintaining the due silence not to disturb others in the room.
  • Common toilets.
  • Stairs.
  • Laundry room. The Residence has washing machines and dryers for the use of residents, which can be used within the normal schedule of the Residence, never during nighttime hours. Each resident must provide the necessary products for using the machines.
  • Surveillance service by camera in common areas

Terraces

Under no circumstances may activities different from those for which they are intended be carried out in them.

The cost of using certain services will be borne by the resident, regardless of the amount of the accommodation price to be paid. These amounts will be communicated to the resident at the time of their use.

Every resident will be responsible for the proper use and treatment of the furniture and fittings located in their room, whether shared or for individual use, and in the common elements of the Residence.

The damages caused in them, due to misuse, negligence, or abuse, will be charged to the person or persons responsible for the damage, deducting, for their compensation, from their deposits, the appropriate amount for the replacement or restoration of the damaged goods and objects, upon corresponding justification.

  • The Residence reserves the corresponding legal actions in claim for the damages caused by the residents.

SIXTH.- RULES FOR THE USE OF FACILITIES AND COMMON AREAS.

The use of facilities and common areas must comply, at all times, with the intended purpose for them and be carried out respecting the rules established in this document.

Residents will observe, at all times, the diligence and care due to avoid damage, impairments, and/or accidents both for themselves and third parties and for the facilities Residents must, at all times, exercise due diligence and care to prevent damage, impairments, and/or accidents to both themselves and third parties, as well as to the facilities. The Residence will not be responsible for any damages caused by the resident or their guests due to negligent use of the facilities and common areas. The use of communal terraces must consider the rest of neighbors and residents from 22:00 to 08:00, Monday to Sunday; any disturbance outside these hours may lead to a breach of contract.

SEVENTH.- COMMUNICATION CHANNELS AND EMERGENCY PROTOCOL.

The official communication channel between the resident and the Residence is via email info@leevinspain.com or contact phone +34 640 96 89 65, available from 08.00 to 22.00  hours.

EIGHTH.- RESIDENT OBLIGATIONS.

The resident expressly assumes the following obligations:

  1. To use the room as their temporary residence exclusively for academic and educational purposes.
  2. Payment for accommodation as well as any other extraordinary service required from the Residence.
  3. To use the room and common areas diligently, without carrying out unhealthy, annoying, or harmful activities for the rest of the residents and neighbors.
  4. To avoid any activity or attitude that disturbs the tranquility of other residents and neighbors, especially avoiding noise as much as possible.
  5. To notify the Residence as soon as possible of the need for necessary repairs to keep the room and common areas in habitable conditions.
  6. The resident is directly and exclusively responsible and exempts the Residence from all responsibility for damages that may occur to people or property and are derived from installations for services and supplies of the room as well as those derived from acts and omissions committed contrary to current legislation or from the misuse of the room and common areas. Also, the resident is directly and exclusively responsible for damages caused by acts or omissions by accompanying persons.
  7. Once the accommodation stay is finished, the room and common areas must be returned in the same conditions and cleanliness state in which they were delivered. Before the return of the keys and/or electronic access cards to the Residence, both Parties will carry out an inspection of the said room.
  8. The resident will pay for minor repairs required due to wear and tear from ordinary use of the room or common areas.
  9. The resident must return all keys and/or electronic access cards of the building and room access at the end of the accommodation duration. In case of loss of the card, the resident will have to pay €20 to cover its cost.
  10. The resident must keep the room and common areas clean and tidy.
  11. The resident will bear the costs caused by damages that could occur concerning windows, locks, or other objects and equipment that make up the water, gas, electricity, heating/air conditioning installations, as well as sanitary and service installations, the TV antenna, and particularly, concerning water evacuation, kitchen repair, blockages in sink, washbasin, shower, or bathtub drains, as well as the repair and replacement of blinds, if any, or other objects and facilities that exist in the room.
  12. Resident visits will be restricted to the study rooms and living room, within the established hours, strictly prohibiting access to the rooms of any person not belonging to the Residence, except for direct family members.

NINTH.- PROHIBITIONS.

  1. It is expressly forbidden for the resident to assign, subrogate, transfer, or sublet the room, in whole or in part, during their accommodation period, as well as its accessories, nor to use it, in whole or in part, for lodging.
  2. It is expressly forbidden for the resident to install engines and machines that produce vibrations or annoying noises or that may affect the consistency, solidity, or conservation of the building in any part of the property.
  3. Serious disturbance of the study or rest of the other residents, and any serious and repeated alteration of the nighttime silence is prohibited.
  4. The entry and presence of animals in the building and rooms are not allowed.
  5. The resident may not paint the walls, doors, and windows of the room’s carpentry in any way, and if done, they will bear the cost of repainting those walls white or replacing the affected pieces in the case of carpentry, whether wood or aluminum.

In the case of holes, stains, or defects on the walls and ceilings of the room, the cost of repair will be paid by the resident.

  1. The resident may not drill or make any type of hole in the ceramic cladding of the room, cook bathrooms, and the rest of the common areas.
  2. The resident is not allowed to modify or disassemble the closets in the rooms and common areas.
  3. The resident may not install new lighting points or electrical and telecommunications outlets different from those already existing in the room and common areas.
  4. The resident may not install any additional type of lock or bolt on the room door.
  5. The resident may not set up any commerce, industry, not even manual, or a professional office or study in the room.
  6. Smoking in the room and in the rest of the common areas is prohibited, except in the areas designated for it. Any guest found smoking inside the building will be charged a fee of €50.00 to cover the high cost of restoring the room to a smoke-free condition.
  7. The possession of weapons, explosives, as well as the consumption of any type of drugs (including marijuana or cannabis), and the consumption of alcoholic beverages are expressly prohibited.
  8. It is expressly forbidden to throw any type of object or substance from the windows or from balconies, terraces, and roofs.
  9. Celebrations of a private nature throughout the property, including common areas, are prohibited, except with prior notification by email to the Residence and as long as the rules of coexistence and use of the common areas of this Regulation are respected.

NINTH.- RIGHT OF ADMISSION AND EXPULSION

The Residence reserves the right of admission regardless of the reservation made by the resident. In the event that money has been delivered on account for the accommodation, the necessary arrangements for the corresponding return will be processed.

TENTH.- EXPULSION OF A RESIDENT AFTER HAVING PROCESSED CHECK-IN.

The Residence reserves the right to decide what are acceptable levels of noise or behavior of the residents staying in the property.

The Residence will previously notify the resident of their misconduct. In case the resident does not comply with the requests or any of the regulatory provisions of the accommodation, the Residence reserves the right to conclude any reservation immediately, without being obliged to pay, under any concept, the refund of the reservation or process any compensatory compensation.

ELEVENTH.- DISCLAIMER OF LIABILITY.

  1. The Residence will not be responsible, under any circumstances, for the damages that may arise from the behavior of the resident and their companions, from the infractions of the current regulations, from the conditions or from this Regulation.
  2. Under no circumstances, will the Residence be responsible for valuables or money that is in the rooms and/or in the common areas.
  3. Under no circumstances will the Residence be responsible for thefts, deterioration, or disappearance of the goods deposited inside the room and common areas by the residents of the same nor for damages caused to third parties by the residents.

TWELFTH.- TERMINATION OF ACCOMMODATION.

The contractual relationship between the resident and the Residence may be terminated for the following reasons:

  • By agreement between the Residence and the resident.

Unilaterally, if one of the parties fails to comply with any of the obligations detailed in this Regulation by notifying the other party with a minimum notice period of one day. Causes for termination, in addition to those legally established and those provided in this Regulation, are those expressly mentioned below:

(i) Non-payment of the accommodation price, as well as the amounts to be paid by the resident.

(ii) Non-payment of the deposit amount.

(iii) When the room or accommodation at the Residence is not used for the established purpose.

(iv) Breach by the resident or the Residence of the obligations assumed in this Regulation.

(v) The commission of damages caused maliciously in the room or common areas or of works not consented by the Residence.

(vi) When in the room or common areas, annoying, unhealthy, harmful, dangerous, or illegal activities take place that endanger the health of the other residents, the healthiness, hygiene, and integrity of the building, or that undermine the tranquility and peace of coexistence.

The termination of the contract by the passage of the agreed time will not give the resident any right to compensation from the Residence, without return or accommodation compensation for other dates for the days not enjoyed.

  • In the event of termination of the contract, the resident will be obliged to hand over the keys (access card) to the Residence and leave the assigned room within a maximum period of twenty-four (24) hours from the receipt of the notification communicating said resolution, without the right to re-enter at any later time.

THIRTEENTH.- VIDEO SURVEILLANCE AND DATA PROTECTION.

  1. The Residence declares that all personal data, including images, will be collected to guarantee the safety of residents, property, and facilities and will not be further processed in a manner incompatible with these purposes.

The resident acknowledges the existence of video surveillance cameras at the access point and common areas, which are duly signposted.

  1. Generally, the residence will not communicate personal data to third parties, except when the provision of a specific service implies the need for a contractual relationship with a processor, and this is strictly

necessary to manage and maintain the relationship between the resident and the said company. The resident consents to such transfer of their personal data. This will only be done for the time strictly necessary to enable the execution of the contract of assignment, under the same conditions and with the same responsibilities required of the Residence. Once the assignment is concluded, the processor will return the residents’ personal data to the Residence and delete any copies they may have.

Furthermore, third parties with whom the Residence has a legal or contractual obligation to provide them, including, for example, the Ombudsman, Judges and Courts, and Security Forces, will also have the right to access these personal data.

  1. The Residence guarantees the exercise of the rights of access, rectification, deletion, portability, limitation, opposition, and information, in the terms established in current legislation. Therefore, the resident may exercise their rights by sending an explicit request, along with a copy of their DNI or national identity document, through the following means:

Finally, the resident is informed that they can address the corresponding Data Protection Agency and other competent public bodies for any claim arising from the processing of their personal data.

FOURTEENTH.- VALIDITY AND MODIFICATION OF THE REGULATION CONTENT.

  • This Regulation will come into force from the date of signature and acceptance of the accommodation conditions at the Residence.
  • The Regulation may be supplemented or modified at any time. Such modifications or supplementary provisions will be communicated to the residents personally by reliable means, with the residents obliged to comply with them without restriction or reservation from the date of receipt of the corresponding notification.
